Eligibility for Expunction and Record Sealing

Expunctions and record sealing are both available to individuals who had been arrested for a crime, but whose case never resulted in either a "guilty" verdict. In other words, the police may have arrested you for a crime, but you were never convicted in a court.

You may be eligible for either service if any of these apply to you:

  • A grand jury never indicted you for the offense for which police arrested you.
  • A judge dismissed the court case against you. 
  •  A jury found you "not guilty" of the offense.
  • You pleaded guilty, but a judge witheld your conviction

Expunction vs. Record Sealing in Florida

  • Expunctions are available to those who have never been found guilty and who have never received a withhold of adjudication. An expunged record will not be listed in public records, and can only be viewed in very limited circumstances.
  • Record Sealing may be sought by individuals who received a withhold of adjudication. For instance, individuals who complete the local Drug Court program would be eligible for record sealing, but not expunction.  

A sealed record also will not be listed in public records, but it can be viewed in circumstances where an expunged record could not. For instance, individuals would need to report their sealed arrest record when applying to purchase a firearm.
